What is a Yukon First Nations Business?

A Yukon First Nations Business is defined in section 1(2)(qq) of the Government of Yukon’s Procurement Policy (GAM 2.6).

(qq)       Yukon First Nations Business means a business that:

  1. is listed on the Yukon First Nations Business Registry and sufficiently proves that:
    1. it is beneficially owned and actively controlled by one or more Yukon First Nations businesses or Yukon First Nations People; and
    2. the bona fide purpose of the business is to provide substantial benefits, whether financial or otherwise, to one or more Yukon First Nations businesses or Yukon First Nations People; and
  2. meets one of the following criteria:
    1. a corporation or partnership where all of the direct or beneficial owners are Yukon First Nations or Yukon First Nations People;
    2. a sole proprietorship owned by a Yukon First Nations Person. A sole proprietorship owned by a non-Yukon First Nations Person, which supports a Yukon First Nations spouse or common law partner, and/or a Yukon First Nations family, may qualify as a sole proprietorship owned by a Yukon First Nations Person. The Government will engage the relevant Yukon First Nations government during its review.
    3. a partnership where at least 50% of the partnership is owned by Yukon First Nations People or organizations described in (qq)(ii)(a) or (qq)(ii)(b);
    4. a corporation with at least 51% of the corporation’s voting shares owned by Yukon First Nations People or organizations described in (qq)(ii)(a) or (qq)(ii)(b); or
    5. a not-for-profit organization in good standing under the Societies Act with at least 51% of its membership comprised on Yukon First Nations People.
